1. General
By placing an order with Clem Custom Creations (Duggy™), you agree to be bound by these Terms and Conditions. These terms apply to all custom and standard 3D printing services provided by us.
2. Orders & Custom Work
All 3D printed products are made to order. Due to the custom nature of 3D printing, slight variations in color, finish, and dimensions may occur and are not considered defects.
Once an order has entered production, it cannot be modified or canceled.
3. Customer-Provided Files
Customers are responsible for ensuring that any files, designs, or models submitted for printing are accurate, printable, and legally owned or licensed. Clem Custom Creations (Duggy™) is not responsible for errors, defects, or failures caused by flawed or unsuitable files.
We reserve the right to refuse to print any file that infringes on intellectual property rights or contains illegal or prohibited content.
4. Intellectual Property
Customers retain all rights to their submitted designs. By submitting a file, you grant Clem Custom Creations (Duggy™) permission to use the file solely for the purpose of fulfilling your order.
We do not claim ownership over customer-submitted designs.
5. Pricing & Payment
All prices are listed in USD. Payment is required in full before production begins. Prices may change without notice.
6. Refunds & Returns
Due to the custom nature of 3D printing, all sales are final once production has begun. Refunds or replacements will only be issued if the product is defective due to our error.
Minor cosmetic imperfections, material characteristics, or print artifacts are not considered defects.
7. Chargebacks & Payment Disputes
If a chargeback is filed on an order, we reserve the right to cancel any related or duplicate orders associated with the same customer. Chargebacks result in significant non-refundable processing fees and administrative costs. Due to these fees and the risk of financial loss, any order involved in or connected to a chargeback may be canceled at our discretion.
Customers are encouraged to contact us directly to resolve any order issues before initiating a chargeback. Filing a chargeback instead of reaching out for support may result in order cancellation and refusal of future service. Responses may exceed 4-7 business days during certain times of the year and around holidays.
8. Shipping & Delivery
Shipping times are estimates and not guaranteed. Clem Custom Creations (Duggy™) is not responsible for delays caused by carriers, customs, or unforeseen circumstances.
Risk of loss transfers to the customer once the order is shipped.
9. Liability Disclaimer
Clem Custom Creations (Duggy™) is not responsible for how printed products are used. 3D printed items are not certified for safety-critical, medical, aerospace, or load-bearing applications unless explicitly stated in writing.
Use of printed products is at the customer’s own risk.
10. Limitation of Liability
Our total liability for any claim related to an order shall not exceed the amount paid for that order. We are not liable for indirect, incidental, or consequential damages.
11. Right to Refuse Service
We reserve the right to refuse or cancel any order at our discretion, including but not limited to suspected fraud, chargebacks, abusive behavior, or policy violations.
12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of [Indiana/USA].
13. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
